Impeachment III: Democrats Haven't Unpacked Their Offices and They're Already Printing Subpoenas

Rep. Robert Garcia of California, the man expected to chair the House Oversight Committee in January, posted two words on social media the night Democrats clinched the House: "LAWYER UP."

He wasn't talking to criminals. He was talking to the White House.

Garcia and Rep. Jamie Raskin of Maryland — likely the next chairman of the House Judiciary Committee — have been tasked by incoming Speaker Hakeem Jeffries with building what Time magazine described as a sweeping investigation apparatus targeting the Trump administration. The target list, as reported by Time: the president's cryptocurrency dealings, Truth Social's sale of faster access to market-moving posts, a luxury presidential aircraft donated by Qataris, tariff exemptions for wealthy allies, and a $620 million Pentagon loan to Vulcan Elements — a company in which Donald Trump Jr.'s firm, 1789 Capital, holds an investment.

Garcia described the scope with characteristic restraint. "You have endless amounts of grift coming out of the White House from the entire family," he told Time. "It's like watching The Sopranos."

But the investigations are the undercard. The main event is the word Jeffries won't say — and won't rule out. Asked directly about a third impeachment of President Trump, Jeffries said Democrats have "not ruled anything in" and "not ruled anything out." Raskin was less coy, he said Democrats "aren't afraid" to impeach Trump for a third time. An October NBC News poll showed a slight majority of respondents supported doing exactly that.

The committee infrastructure is already mapped. Sen. Sheldon Whitehouse of Rhode Island takes the Senate Judiciary Committee. Sen. Richard Blumenthal of Connecticut gets the Permanent Subcommittee on Investigations. Garcia gets Oversight. Raskin gets Judiciary. That's four gavels pointed at one administration before a single hearing has been scheduled.

Raskin framed the strategy as a two-for-one. "Accountability and affordability are not a fork in the road for us politically," he said. "They are two sides of the same coin." Translation: we'll investigate Trump while telling voters we're lowering their grocery bills. Democrats flipped at least 29 House seats and picked up Senate victories in Texas, South Carolina, Kansas, and Iowa. The mandate, as they see it, is broad.

What the mandate actually contained was a list of kitchen-table complaints — tariffs, Medicaid, prescription drug prices. An exit poll didn't ask voters to rank "subpoena Jared Kushner" among their priorities. But that's the first item on Garcia's witness list. Kushner's business dealings, his Middle East negotiations, his Gulf state investment ties — all of it queued up for public hearings.

Sen. Cory Booker of New Jersey offered a lonely dissent from within his own party. "If we make Donald Trump the center of our focus, we will lose this moment in history," he said. "We need to deal with the American people's problems." Rep. Jim Himes of Connecticut went further: "I'm really worried that we're going to misread victory as an endorsement of us or America falling in love with Democrats."

They should be worried. The first two impeachments produced zero convictions and turned Trump into the most successful political comeback story in American history. The investigation-as-governance playbook isn't new — Democrats ran it from 2019 to 2020, and Trump won 74 million votes afterward. Now they're loading the same cannon and expecting a different trajectory.

President Trump seemed unbothered. "What happens is I veto everything," he said. "You veto, veto, veto, and then they come and they say, 'How do we get it done?'"

Democrats' first-week legislative agenda includes rescinding Trump's tariffs, restoring expired Affordable Care Act premium subsidies, reversing $1 trillion in Medicaid cuts, and a resolution demanding Trump end military operations in Iran or obtain congressional authorization. Every one of those items requires the president's signature.

Twenty-nine seats. Four committee gavels. One impeachment they won't rule out. Zero votes to override a veto.
